ArtBitz Stock Illustration & Design images MAY
BE USED for:
Any advertising, promotion, packaging, communication,
and editorial use in the following mediums: web site
graphics, internet banners, print and broadcast ads,
newspapers, packaging, direct mail, consumer magazines,
trade magazines, annual reports, billboards, point-of-sale
displays, brochures, newsletters, invitations, impermanent
signs, transit boards, sales kits, trade show displays,
and free promotional items.
Without an extended license, ArtBitz Stock Illustration
& Design images MAY NOT BE USED for:
Imprinting on product for sale, such as clothing (for
example, t-shirts where the ArtBitz image makes the
shirt unique), fabrics or other merchandise, cards,
or books (no extended license is required for editorial
use by magazines and newspapers). ArtBitz images also
may not be used for trademark, sub licensing, defamatory
or libelous purposes. To purchase an extended license
for any of the above purposes, contact ArtBitz. ArtBitz
images may not be redistributed, syndicated, resold,
sublicensed, or placed online in a downloadable format.
ArtBitz images may not be used by any person or entity
other than the Licensee for projects for the Licensee
or the Licensee's clients. Since ArtBitz images are
licensed on a nonexclusive basis, they may not be
used in any logo, trademark or service mark applications.
All rights not specifically granted above are retained
by Licensor. Except as specifically provided in this
agreement: 1) no ArtBitz image(s) may be shared or
copied; and 2) you many not create a network of servers,
either with or without a central location, which enables
others to share the ArtBitz image(s).
Use of the ArtBitz image(s), or any part thereof,
as a trademark or service mark is not permitted. Pornographic
use, use that would be defamatory or libelous or use
that is otherwise unlawful is prohibited. No ArtBitz
image may be resold, sublicensed or in any other way
made available for use, download or distribution separately.
Similarly, ArtBitz images may not be distributed
or sold as part of a CD or other media presentation
collection. One copy of the ArtBitz image(s) may be
made for backup purposes only, but may be used only
if the original art file is destroyed or otherwise
irretrievably lost. If you would like to share ArtBitz
image(s), with greater than 5 specific people (including
you) within a single organization, please contact
ArtBitz for an upgrade license.
You may not include ArtBitz images in any electronic
template or application, including those that are
web-based, where the purpose is to create multiple
impressions of an electronic or printed products for
resale, including, but not limited to, web site design
templates for resale, presentation templates for resale,
or electronic greeting cards.
ArtBitz warrants these image(s) to be free from defects.
The sole and exclusive remedy for a breach of the
foregoing warranty is the replacement of the ArtBitz
image(s) or refund of the purchase price, at ArtBitz's
option.
ARTBITZ MAKES NO OTHER WARRANTY, EXPRESS OR IMPLIED,
INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES
OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Some states do not permit the exclusion of implied
warranties, and you may have other rights which may
vary from state to state.
ARTBITZ NOR THEIR LICENSORS SHALL BE LIABLE TO YOU
OR ANY OTHER PERSON OR ENTITY FOR ANY GENERAL, SPECIAL,
DIRECT, INDIRECT, CONSEQUENTIAL, INCIDENTAL OR OTHER
DAMAGES ARISING OUT OF THIS LICENSE OR OTHERWISE.
